Subject: Website Terms and Conditions – Product Purchases

A. Definitions

In these Terms and Conditions, the following terms shall have the meanings set forth below:

  • The Company – Hot Seasons Ltd., Company No. 51717770

  • The Website – The website located at: hotseasons.co

  • Products – The products displayed and offered for sale on the website.

  • Business Day – Weekdays (Sunday to Thursday), excluding the day the order is placed, Fridays, Saturdays, holiday eves, holidays, official days of rest, intermediate days of holidays, memorial days, and national emergency days.

  • User – Any individual using the website, its services, and contents, including placing and purchasing orders.

General

  • These Terms are written in the masculine form for convenience only and refer to all genders. Where the plural is used, it may also refer to the singular and vice versa.

  • The website at hotseasons.co (hereinafter: “the Website”) is owned and operated by Hot Seasons Ltd. (hereinafter: “the Company”).

  • The Website serves as a virtual store for the sale of jewelry and/or home goods and/or any other product offered on the site (hereinafter: “the Products”).

  • These Terms constitute the legal basis and binding agreement governing the relationship between the Company and users of the Website. Browsing or performing actions on the Website constitutes the user’s agreement to act according to the Terms. By using the Website, the user agrees to be bound by these Terms and waives any claim or demand against the Company and/or its directors and/or employees.

  • If the user believes that a product purchased or service received is defective or lacking, they may contact customer service at the email above, and the Company will address the issue as soon as possible.

  • The user acknowledges that the Company may update the Terms at its sole discretion and without prior notice.

  • Product prices include VAT where applicable but do not include shipping fees.

  • All product images on the Website are for illustration purposes only. The user shall have no claim based on discrepancies in appearance.

  • The Company may update product prices and shipping rates at any time without notice. The valid price for an order is the one displayed at the time the order is completed, including credit card information. If prices were updated before order completion, the updated prices shall apply.

  • These Terms apply to the Website and any other media platforms such as Facebook, Instagram, etc.

  • The Company complies with all applicable laws regarding privacy. See the privacy policy for more information.

  • Tagging content on Instagram with tags such as #hot.seasons / @hot.seasons constitutes permission to share the tagged content on the Website. If a user does not wish their content to be shared, they may contact customer service at: hotseasons.co@gmail.com

  • The Company reserves the right to cease Website operations at any time without prior notice, though confirmed orders made before such cessation will be honored.

Order Procedure

  • To place an order, users must enter their full details, including (but not limited to): full name, phone number, email, and residential address. Providing complete and accurate information is a precondition for completing an order. Inaccurate or incomplete information may prevent the order from being completed or delivered. If an order is returned due to incorrect details, the user may be charged an additional shipping fee.

  • The Company will use user details only in accordance with the Website's privacy policy, which is an integral part of these Terms.

  • Upon placing the order, the user’s credit card details will be verified automatically. If the transaction is approved, a confirmation email will be sent to the user.

  • The order details as entered by the user and recorded in the Company’s systems will serve as conclusive proof of the transaction.

  • If the credit card company does not approve the transaction, the user will be notified and requested to provide an alternative payment method. If not provided, the order will be canceled.

  • In addition to credit card approval, the order is also subject to the availability of the requested product in the Company's inventory at the time of order or delivery. Even if a product is marked as in stock on the Website, it may be out of stock in practice. In such cases, the order will be canceled, and any charges will be refunded. The user shall not have any claim or demand for damages (direct or indirect) resulting from such cancellation.

  • Note: Even if a product is marked as in stock on the Website, it may turn out to be unavailable. In such a case, the transaction will be canceled, and the user will be refunded, with no further claims allowed.

Company Liability

  • Subject to applicable law, the Company and/or its affiliates will not be liable for any direct, indirect, consequential, or special damage caused to the user or third party due to use or purchase via the Website, including (but not limited to) communication providers, unauthorized access, hacking attempts, or issues with shipping and delivery services.

  • For imported products, the Company confirms they meet Israeli standards. Any complaint about compliance should be directed to the manufacturer, not the Company.

  • In any event, the Company’s liability shall not exceed the amount paid by the user for the product. The Company shall not be liable for indirect damages such as loss of income or profits.

  • Typographical errors in product descriptions do not bind the Company.

  • All product use is solely at the user's responsibility.

Intellectual Property

  • All intellectual property on the Website and/or in the products—including copyrights, designs, methods, and trade secrets—belong solely to the Company or third parties (as applicable).

  • This includes content, services, product lists and descriptions, designs, software, code, graphics, text, and more.

  • You may not copy, reproduce, distribute, sell, market, translate, alter, publish, broadcast, display, license, create derivative works from, reverse engineer, or use any content from the Website—fully or partially—without prior written permission from the Company or the relevant third party.

  • Any trademarks (including images, diagrams, etc.) published by companies selling via the Website are their property and may not be used without their permission.

  • The Website must be used for legal purposes only.

  • You may not use or allow the use of any software or tools (such as crawlers, bots, etc.) to scan or extract Website content. Creating collections or databases from Website content is prohibited.

Promotions and Discounts

  • The Company may offer promotions or discounts to Website users from time to time, but is not obligated to do so. Any such offers will comply with applicable law and these Terms.

  • The Company reserves full right to change or cancel any promotions or offers without prior notice.

  • יום עסקים – ימי ראשון עד חמישי, לא כולל: יום ביצוע ההזמנה, ימי שישי, שבת, ערבי חג, חג, שבתון, חול המועד, ימי זיכרון וימי חירום לאומי

  • משתמש/ת – כל אדם העושה שימוש באתר, בשירותים ובתכנים הכלולים בו, לרבות הזמנת ורכישת מוצרים

ב. כללי

  • התקנון כתוב בלשון זכר אך מתייחס לשני המינים.

  • האתר בבעלות הוט סיזנס בע"מ ומופעל על ידה

  • האתר משמש כחנות וירטואלית למכירת תכשיטים, מוצרים לבית או כל מוצר אחר שמוצע בו

  • הגלישה באתר ו/או ביצוע רכישות מהווים הסכמה לתקנון

  • שאלות/פניות ניתן לשלוח למייל: hotseasons.co@gmail.com

  • החברה רשאית לעדכן את התקנון לפי שיקול דעתה וללא הודעה מוקדמת

  • מחירי המוצרים כוללים מע"מ (אם חל), אך לא כוללים דמי משלוח

  • התמונות באתר הן להמחשה בלבד

  • מחיר המוצר שיחול הוא זה שהופיע באתר בעת השלמת תהליך ההזמנה

  • התקנון חל גם במדיות חברתיות כגון אינסטגרם ופייסבוק

  • תיוג עם ההאשטגים #hot.seasons ו/או @hot.seasons מהווה הסכמה לשיתוף התוכן באתר

  • החברה רשאית להפסיק את פעילות האתר בכל עת (תוך כיבוד הזמנות שאושרו עד לאותו מועד)

ג. אופן ביצוע ההזמנה

  • ביצוע הזמנה מותנה במסירת פרטים מלאים ונכונים: שם, טלפון, אימייל וכתובת

  • הזנת פרטים שגויים עלולה למנוע קבלת ההזמנה ולגרום לחיוב נוסף עבור משלוח חוזר

  • שימוש בפרטים ייעשה בהתאם למדיניות הפרטיות של האתר

  • לאחר ביצוע ההזמנה, תתבצע בדיקת אשראי ואישור מול חברת האשראי

  • אישור ההזמנה יישלח למייל של המשתמש

  • רישום ההזמנה במערכות החברה מהווה ראיה סופית לנכונותה

  • במידה והעסקה לא אושרה – המשתמש יתבקש למסור אמצעי תשלום חלופי, אחרת ההזמנה תבוטל

  • האספקה כפופה לזמינות המלאי, גם אם נרשם באתר שהמוצר במלאי

  • במידה והמוצר אינו זמין – ההזמנה תבוטל והלקוח יזוכה

  • לא תהיה למשתמש כל טענה או דרישה במקרה של חוסר במלאי

ד. אחריות החברה

  • החברה לא תהיה אחראית לנזקים ישירים או עקיפים כתוצאה משימוש באתר, לרבות בעיות תקשורת, פריצות, או תקלות משלוח

  • המוצרים המיובאים על ידי החברה עומדים בתקנים הנדרשים. תלונות על תקן יש להפנות ליצרן

  • אחריות החברה מוגבלת לגובה הסכום ששולם בפועל בלבד

  • לא תחול אחריות לנזקים עקיפים כמו אובדן הכנסה או רווח

  • טעות סופר בתיאור מוצר לא תחייב את החברה

  • שימוש במוצרים באחריות המשתמש בלבד

ה. זכויות יוצרים

  • כל זכויות הקניין הרוחני באתר ובמוצרים – שייכות לחברה או לצדדים שלישיים

  • חל איסור להעתיק, לשכפל, לשווק, לתרגם או לפרסם כל חלק מהתוכן באתר ללא אישור מראש ובכתב

  • שימוש לא מורשה בתכני האתר מהווה הפרת זכויות

  • יש להשתמש באתר למטרות חוקיות בלבד

  • אסור להפעיל רובוטים, סורקים או תוכנות לאיסוף אוטומטי של מידע מהאתר

ו. מבצעים והטבות

  • החברה רשאית להציע מבצעים והטבות, אך אינה מחויבת לכך

  • החברה שומרת לעצמה את הזכות לשנות או לבטל כל מבצע או הטבה בכל עת
